Terms and Conditions

The Program allows users to receive SMS/MMS messages by affirmatively opting in through online forms, in-person sign-up, or during the course of business with us. By participating, you agree to receive autodialed or prerecorded marketing messages at the phone number associated with your opt-in; consent is not required to make a purchase from us.

Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message to opt out. You may receive one final confirmation message. These are the only reasonable methods of opting out.

Users who opt in can expect to receive messages concerning CRM automation services, video production updates, account onboarding, billing, and marketing/promotional content from VA Media Fx.

Message and data rates may apply. Message frequency varies based on your interaction with us and your service plan.

The Program is offered 'as-is' and may not be available in all areas at all times. We are not liable for delays or failures in message delivery caused by your wireless carrier.

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use VA Media Fx services or participate in this Program.

Any dispute, claim, or controversy arising out of or relating to this Agreement, our services, or the breach, termination, enforcement, interpretation, or validity thereof, will be determined by binding arbitration in Chicago, Illinois before one arbitrator, administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules then in effect. The arbitrator shall apply the substantive laws of the State of Illinois, without regard to conflict of laws principles. The parties agree to arbitrate solely on an individual basis; this Agreement does not permit class arbitration. The arbitrator shall have no authority to award punitive damages. If a dispute proceeds in court rather than arbitration for any reason, the parties waive any right to a jury trial.

VA Media Fx provides CRM/marketing automation and AI video production services on a subscription basis. Setup fees are non-refundable once onboarding work has begun. Monthly subscriptions may be cancelled with 30 days' written notice; no refunds are provided for partial months. VA Media Fx reserves the right to modify these Terms at any time; continued use of our services after changes constitutes acceptance.

You warrant that you have the authority to agree to these Terms on behalf of yourself or your business. If any provision of this Agreement is found unenforceable, the remainder shall remain in full force and effect. We reserve the right to update this Agreement; material changes will be communicated to active clients.
